TOWARDS A EUROPEAN LAW ON ARTIFICIAL INTELLIGENCE

Given the position of many European groups on the need to regulate the use and application of Artificial Intelligence systems in Europe (see DYNA News, https://www.revistadyna.com/noticias-de-ingenieria/suspension-temporal-del-desarrollo-de-inteligencia-artificial), the Community has warned that it has been considering this problem since 2019 and defining the lines of action to promote a law in its field of competence.

First of all, it has identified the six main problems posed by the development and use of AI systems, due to their specific characteristics: that the use of AI poses increased risks to the security of citizens; that the use of AI poses increased risks of violation of citizens' fundamental rights and Union values; that authorities do not have the necessary powers, procedural frameworks and resources to ensure and monitor that the development and use of AI complies with the applicable rules; legal uncertainty and the complexity of applying existing rules to AI systems discourage businesses from developing and using AI systems; lack of confidence in AI impedes its development in Europe and reduces the overall competitiveness of the EU economy. The EU is also concerned that fragmented measures create obstacles to the cross-border single market for AI and threaten the Union's digital sovereignty.
On that basis, it intends to create the Artificial Intelligence Act, the world's first comprehensive law on this subject, as it believes there is a clear need to ensure better conditions for the development and use of this innovative technology as its applications can bring many benefits, such as better healthcare, safer and cleaner transport, more efficient manufacturing and cheaper and more sustainable energy.
For appropriate action, the risk possibilities have also been classified:
Unacceptable risk
AI systems of unacceptable risk are those that are considered a threat to people and will be banned.
High risk
AI systems that adversely affect security or fundamental rights. In this respect, so-called generative AI (such as ChatGPT or similar), would have to comply with transparency requirements, such as disclosing that the content has been generated by AI, designing the model to avoid generating illegal content, and publishing summaries of the copyrighted data used for training.
Limited risk
AI systems, such as those that generate or manipulate image, audio or video content, will have to meet minimum transparency requirements to enable users to make informed decisions.
