ACTUALIZACIÓN Y AMPLIACIÓN DEL RÉGIMEN COMUNITARIO DE COMERCIO DE DERECHOS DE EMISIÓN DE GASES DE EFECTO INVERNADERO

RESUMEN
Con la aprobación de la Directiva 29/2009/CE, que modifica la Directiva 2003/87/CE en materia de régimen para el comercio de derechos de emisión de gases de efecto invernadero en la Comunidad, la Unión Europea quiere perfeccionar dicho régimen y, así, facilitar un instrumento adecuado para conseguir los objetivos de reducción de emisiones, fijados para 2020: en especial, la reducción de las emisiones de dióxido de carbono (CO2) en un 20% con respecto a los niveles de 1990). Sin obviar las virtudes de este régimen como instrumento innovador para la reducción de emisiones, es necesario armonizarlo a través de la adopción de normas comunes que garanticen la igualdad de condiciones de las instalaciones afectadas, así como actualizarlo, entre otros, aumentando su ámbito de aplicación y estableciendo un sistema de asignación vuelto a incentivar la reducción de emisiones. Al mismo tiempo, la regulación que se adopte desde la UE no debe obviar los posibles problemas de competencia que puedan surgir para las industrias afectadas por este régimen de comercio de derechos de emisión, más concretamente, el problema de la fuga de carbono: este fenómeno hace referencia al riesgo de que las industrias europeas se trasladen fuera de la UE por no poder hacer frente a la competencia de otros países con limitaciones menos estrictas en esta materia. En todo caso, el régimen establecido por la Directiva 29/2009/CE queda sujeto a posibles modificaciones en función de los acuerdos de cambio climático que, a nivel internacional, pueda adoptar la Comunidad Europea.

COMMUNITY SYSTEM UPDATING AND EXTENSION CONCERNING GREENHOUSE GAS EMISSIONS DUTIES TRADING.

ABSTRACT
Approving 29/2009/CE Directive, that amends Directive 2003/87/EC, relating to a trading system for allowances of greenhouse gas emissions in the Community, the European Union wants to improve this system, and, in that way, providing an appropriate tool for achieving the emissions reduction targets, set for 2020: in particular, reducing the emissions of carbon dioxide (CO2) in a 20% compared to 1990 levels. Recognizing the virtues of this system as an innovative tool for reducing emissions, it should be harmonized through the use of common standards that ensure equal conditions of the facilities affected and their update, among others, increasing their scope and establishing a system of re-allocation to reduce emissions. At the same time, the regulation adopted by the EU should not address possible competition difficulties, that may arise for the industries affected by this emission trading system, more specifically, the problem of carbon leakage: the phenomenon refers to the risk that European industries must move outside the EU for not being able to cope with competition from other countries with less stringent limitations on this matter. In any case, the regime established by Directive 29/2009/CE is subject to possible changes in function of international agreements on climate change that the Community and third countries might conclude.
